Part of Why prospecting software compliance rules must be set before you scale
Prospecting software ad claims without evidence or a lawful basis
A practical England guide to prospecting software ad claims, covering evidence, UK GDPR lawful bases, PECR email rules and the CAP Code.
What to take away
- A sales manager in Manchester sees a hypothetical prospecting software vendor promise "guaranteed 40 meetings a month" on a LinkedIn ad. If unsupported, that performance claim risks breaching applicable advertising rules, including the CAP Code.
- The rules bite hardest on three thingsoutcome claims you cannot evidence, hidden pricing, and prospect data used without a lawful basis.
- Advertising claims and data handling are separate duties. A compliant ad does not cure an unlawful prospect list, and a lawful list does not cure a misleading claim.
- This checklist covers England. Scotland, Wales and Northern Ireland have their own enforcement arrangements, though the 2008 Regulations apply across the UK.
- Individual cases need a qualified adviser, not a blog post.
The claim itself: what English law expects
Substantiate every outcome promise
For a B2B advert, the Business Protection from Misleading Marketing Regulations 2008 prohibit misleading advertising to businesses. The CAP Code also requires objective claims to be supported by evidence held before publication, and the Advertising Standards Authority administers the Code. A claim that your tool delivers a specific number of qualified leads needs evidence behind it.
Ad claim vs evidence
Claim in ad
- Lead volume
- Typical average, not best case
- Testimonial
- Dated record of the basis
- Headline price
- Billing period and term
- Free trial
- What happens at end
What you must hold
- Lead volume
- Testimonial
- Headline price
- Free trial
Testimonials count as claims. A quoted customer saying pipeline doubled is a factual assertion you must be able to support. Keep dated records of the basis for each headline figure.
Price, term and exit terms in the ad
Omitting the annual commitment from a headline price is an omission that can mislead. State the billing period, minimum term and any per-seat uplift in the same place as the price.
If you advertise a free trial, say what happens when it ends. Silent auto-conversion to a paid plan is the kind of practice trading standards officers treat as aggressive selling.
The data behind the campaign
Lawful basis before the first email
Before a prospect enters your sequence, you need a lawful basis under UK GDPR for processing their personal data. The Article 6 lawful bases are consent, contract, legal obligation, vital interests, public task and legitimate interests; the Data Protection Act 2018 supplements UK GDPR. The ICO's guidance on choosing your lawful basis for direct marketing explains how legitimate interests and consent differ in practice.
Legitimate interests may be appropriate for B2B prospecting, but it is not automatic: identify the interest, show that the processing is necessary and balance it against the person's rights and reasonable expectations in a documented balancing test. Use consent or another Article 6 basis where that fits better. Record your reasoning before the campaign.
Sector evidence in regulated markets
For prospecting software, claims about contact accuracy, data coverage, lead volumes, meeting outcomes or sector reach need evidence that matches the wording, audience and measurement period. A neutral ONS statistic may describe market context, but it cannot substantiate the tool's own performance.
Our England regulations explainer covers how sector-specific rules layer on top of the general advertising duties.
A numbered compliance sequence
- List every factual claim in the campaignlead volumes, response rates, customer names, awards.
- Attach evidence to each claim and date it. Delete anything you cannot support.
- Check the advertised price against the contract, including term and renewal.
- Document your lawful basis for each prospect list and record the balancing test.
- Review suppression lists and opt-outs before the send.
- Log who approved the creative and when.
- Re-check claims quarterly, because your averages move.
A team running paid social at, for example, £2,000 a month should treat steps one to three as a pre-flight check, not an annual audit.
The UK rules and compliance guide sets this England checklist alongside the wider 2027 framework.
Common questions
Do these rules apply to B2B advertising only?
No. B2B claims are subject to the Business Protection from Misleading Marketing Regulations 2008, and advertising must also comply with the CAP Code. The Advertising Standards Authority administers the Code, while trading standards can enforce relevant legislation. Check the rules for the audience and channel rather than assuming consumer and business advertising are treated identically.
Can I use purchased prospect data?
A lawful basis under UK GDPR is necessary when purchased data contains personal data, but it does not by itself authorise marketing by email. Check how the data was collected, the supplier's provenance trail and the relevant PECR rules for your channel. Purchased lists often fail that test, so ask the supplier for the provenance trail in writing before you load anything.
What happens if a claim turns out to be wrong?
Correct or withdraw the claim quickly and keep a record of the decision. Prompt correction reduces the risk of enforcement, though it does not remove liability for losses already caused.
Does this checklist cover Scotland and Wales?
No. This article addresses England. Enforcement bodies differ across the UK, so check the position where your audience sits before you run the campaign.
